I present them General conditions of Sale have as their object the purchase of products remotely via the telematic network on the site www.ddfnautica.it , sold directly by DDF Nautica S.r.l.s. with headquarters in Fondi in Via Olbia, each purchase transaction will be governed by the provisions of the Legislative Decree. 185/99, D.Lgs. 206/05; the information aimed at the conclusion of the contract will be subject to art. 12 del D.Lgs. 70/03 e, with regard to the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree. 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The sales contracts of the products on the site www.ddfnautica.it, are considered concluded when the purchase order placed by the customer is received at ddfnautica.it and the latter accepts it. The ddfnautica.it will promptly send the customer a receipt of the purchase order made by the customer. The client, by electronically sending your purchase order, declares to have read and accepted these general conditions of sale and undertakes to observe and respect them in its relations with the ddfnautica.it

TREATMENT OF PERSONAL DATA

The ddfnautica.it pursuant to art. 13 del D.Lgs. 196/2003 informs that the personal and fiscal data acquired also verbally in reference to the commercial relationships established, provided directly by the interested parties, or otherwise acquired as part of the company's business, will be processed in compliance with the aforementioned legislation, including the confidentiality obligations provided for by them. In relation to the aforementioned, the rights referred to in the article may be exercised 7 D.Lgs. 196/2003.

OBLIGATIONS OF THE CUSTOMER

The Client is obliged, before submitting your purchase order, to read these carefully General conditions of Sale. The forwarding of the purchase order implies their full knowledge and acceptance. The Client is obliged, in the end, once the online purchase procedure has been completed, to print and keep the present General conditions of Sale, already viewed and accepted during the contract conclusion phase.

DEFINITION OF THE ORDER

By sending the online order, the Customer sends to ddfnautica.it a proposal to purchase the product and/or products added to the cart. When the Customer places an online order for the products he has placed in the cart, agrees to purchase them at the price and terms indicated herein General conditions of Sale.

PURCHASE METHOD

The customer buys the product, whose characteristics are illustrated online in the relative descriptive and technical sheets, at the price indicated therein plus the delivery costs specified on the site. Before submitting the purchase order, the unit cost of each selected product is summarized, the total cost in the event of the purchase of multiple products and the related delivery costs. Once the purchase order has been submitted, the customer will receive from ddfnautica.it an e-mail message certifying confirmation of receipt of the purchase order and containing information relating to the main characteristics of the purchased good, a detailed indication of the price, of delivery costs, applicable taxes and means of payment.

PAYMENT

The customer can make the payment due by choosing one of the following methods listed:

• Payment with Paypal: the consumer can use the payment procedure with PayPal, suitable to ensure the confidentiality of the data provided by customers. For any information and further Legal Agreements, the Customer is referred to consult the site www.paypal.com.
• Payment by bank transfer: payment by bank transfer can be made using the details displayed during the online ordering procedure. In the event that payment is made by bank transfer, the purchased good will be shipped in the manner described in the following paragraph “Delivery of Products”, to the address indicated by the customer upon receipt of the credit, therefore on average within two/five days after the transfer has been made (the timing varies depending on the credit institution used).

DELIVERY OF PRODUCTS

The purchased good, together with the relevant invoice, is delivered by courier to the address specified by the Customer when ordering online. The ddfnautica.it guarantees the delivery of the purchased product in the shortest possible time. In the event of non-delivery due to the recipient's absence, to the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (DDF Nautica S.r.l.s.).

The shipped items that will be damaged or lost by the couriers will be refunded only if the insured shipment will be selected during the purchase phase.

Shipping to Italy is free for orders over € 150,00.

Below this threshold the cost starts from € 7,50.

For postal codes considered remote and/or disadvantaged the cost starts from € 8,50 for Italy, even exceeded the threshold of € 150,00.

GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS

Products purchased on the site ddfnautica.it are subject to the regulations on the sale of consumer goods. The delivered products comply with the characteristics illustrated online in the relative descriptive and technical sheets. The ddfnautica.it is liable to the customer for any lack of conformity existing at the time of delivery of the goods.

RIGHT OF WITHDRAWAL

The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any purchase contract concluded with DDF Nautica S.r.l.s., without any penalty and without the need to provide explanations , within the deadline of 7 (set) days starting from receipt of the goods. The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the site www.ddfnautica.it.

To exercise the right of withdrawal, the consumer must send a written communication to the email address within the aforementioned deadline info@ddfnautica.it.

If the goods have been delivered, the customer is required to return it to DDF Nautica S.r.l.s. within the deadline of 14 (fourteen) days starting from the date of delivery of the goods. The good must be returned packed in its original packaging. The returned product must be accompanied by a copy of the electronic receipt of the order.

After sending the withdrawal notice, the Customer must take action to return the goods to DDF Nautica S.r.l.s., using a courier of your choice. The goods must be returned intact and carefully packaged in the original packaging, complete with all accessories. According to the law, the shipping costs relating to the return of the goods are borne by the Customer; unless the product is returned because it arrived damaged or malfunctioning , in this case the costs will be borne by DDF Nautica following a careful verification of the causes of the damage or malfunction of the product. DDF Nautica is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments.

The right of withdrawal automatically lapses if it is ascertained that:

• The original box or packaging is missing
• The returned good is not complete with all its elements(accessories, labels, note informative, ecc.)
• The returned goods are found to have been used or damaged by the consumer (signs of wear, scratches, deformations etc.)

In the event of forfeiture of the right of withdrawal, DDF Nautica reserves the right not to proceed with the refund and will return the goods purchased to the sender, charging him the shipping costs..

DDF Nautica informs that all products ordered by the consumer not present on the website www.ddfnautica.it and items produced according to specific customer needs are not subject to the right of withdrawal, for example propellers since they are ordered at the customer's request and other items.

If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause and under conditions that the goods are intact and unused, the DDF Nautica S.r.l.s. is required to reimburse the sums paid by the customer. In particular, the DDF Nautica S.r.l.s. will proceed free of charge to the transmission of the re-credit order relating to the cost of the goods shipped within 30 (thirty) days from the date on which it became aware of the customer's exercise of the right of withdrawal. This operation will be carried out by crediting the sum to the bank account indicated by the customer. The DDF Nautica S.r.l.s. has the right to reject any product returned in ways other than those specified above, as well as products for which the return costs have not been fully paid by the customer, or the methods and times indicated for the communication of the exercise of the right of withdrawal have not been respected.

EXPRESS TERMINATION CLAUSE

In the event of total or partial non-payment of the purchase price of the asset, the DDF Nautica S.r.l.s. reserves the right to declare, pursuant to and for the purposes of art. 1456 of the Civil Code, terminated this contract by sending a written communication to the customer's email address.

For any complaints or clarifications, the customer will have to send an e-mail to info@ddfnautica.it.

APPLICABLE LAW AND JURISDICTION

This contract is regulated by the Italian law. The exclusive jurisdiction and forum for any legal action brought by the Purchaser pursuant to this guarantee or any further legal guarantees will be the Court of Latina.
